The Preamble
Welcome to the FlorianBD ecosystem. These Terms of Service ("Protocols") govern your access to and use of the FlorianBD website, mobile applications, and biological marketplace services.
By engaging with our platform, you enter into a legal kinship with FlorianBD. We have designed these protocols to ensure a flourishing environment for gardeners, nurseries, and plant enthusiasts alike.
Acceptance of Protocols
Accessing the FlorianBD Nexus constitutes your absolute agreement to these protocols. If you do not agree to every clause within this framework, you must terminate your connection immediately.
Universal Application
These terms apply to all visitors, users, nurseries, and botanical professionals who interact with the system.
Instant Propagation
We reserve the right to modify these protocols. Changes are effective immediately upon being archived on this page.
Digital Signature
Your continued use of the platform serves as a recurring digital signature of acceptance.
Node Security (User Accounts)
When you establish a node (account) within our network, you must provide data that is accurate, complete, and current at all times.
Identity Integrity
- Minimum Age: 18 Earth years.
- Verified contact coordinates required.
- No impersonation of other biological entities.
Credential Security
You are the sole architect of your password's integrity. Any activity under your node is your responsibility.
Breach Protocol
You must notify our Security Fortress immediately upon discovering any unauthorized access to your node.
Biological Assets & Trading
FlorianBD is a marketplace for living organisms. The trade of biological assets requires specialized understanding.
Nursery Representation
Nurseries represent that all specimens are healthy, pest-free, and genetically consistent with descriptions.
Biological Variance
As living entities, plants may exhibit natural variance in height, foliage, and color from reference images.
Availability Logic
Inventory nodes are updated in real-time, but we reserve the right to cancel orders if a specimen fails pre-shipping health audits.
Value Exchange (Payments)
All financial transactions are secured through encrypted tokenization and verified MFS partners.
- Currency: All transactions are settled in Bangladeshi Taka (BDT).
- Taxes: Prices include applicable VAT as per national regulations.
- Refunds: Processed according to our Return Protocol.
- Fraud Protection: Suspicious transactions are instantly flagged and quarantined for manual audit.
Biological Logistics
We utilize specialized "Eco-Vent" transit nodes to ensure specimen survival during the logistics phase.
Risk Transfer
Responsibility for the specimen's health transfers from the nursery to the logistics partner upon package sealing.
Delivery Success
You must ensure an authorized receiver is present at the coordinates. Plants cannot survive prolonged holding in transit hubs.
Force Majeure
Delays caused by climatic disasters, regional instability, or biological quarantine are beyond our control.
Intellectual Property (The Digital Flora)
The FlorianBD platform, including its original content, features, and functionality, are the exclusive property of FlorianBD.
- Trademarks: The name "FlorianBD" and our logo are protected symbols.
- Visual Assets: Photography of rare specimens remains the property of the respective nursery or FlorianBD.
- AI Logic: Our proprietary "Plant Matcher" algorithms are trade secrets.
Limitation of Liability
To the maximum extent permitted by law, FlorianBD shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the service.
Specifically: FlorianBD is not liable for plant death caused by improper care, climatic shock after delivery, or user negligence.
Governing Law & Jurisdiction
These Protocols shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions.
Any disputes arising from these terms shall be resolved through binding arbitration in Rangpur/Dhaka, Bangladesh.
